CONSUMER RIGHTS | RIGHT OF WITHDRAWAL – CANCELLATION & RETURN CONDITIONS
GENERAL:
By placing an electronic order through this website, you are deemed to have accepted the preliminary information form and the distance sales contract presented to you.
Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), as well as other applicable laws in effect, regarding the sale and delivery of the purchased product.
Shipping costs for product delivery are borne by either the buyer or the seller in accordance with the rules specified on www.drmayahome.com.
Each purchased product will be delivered to the person and/or organization at the address specified by the buyer within the legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.
The purchased product must be delivered complete and in accordance with the specifications specified in the order, along with any required documents such as a warranty certificate and user manual, if applicable.
If it becomes impossible to sell the purchased product, the seller must inform the buyer of this situation in writing within 3 days of becoming aware of it. The total payment must be refunded to the buyer within 14 days.
IF THE PURCHASED PRODUCT PAYMENT IS NOT MADE:
If the buyer fails to pay for the purchased product or cancels the payment in the bank records, the seller’s obligation to deliver the product ceases.
PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:
If it is determined after the delivery of the product that the payment was made using the buyer's credit card without authorization, and the product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days, with the shipping cost borne by the seller.
UNFORESEEN CIRCUMSTANCES DELAYING DELIVERY:
If unforeseen circumstances beyond the seller’s control occur, preventing the product from being delivered on time, the buyer will be informed of the situation. The buyer may request to cancel the order, replace the product with a similar one, or postpone delivery until the obstacle is resolved. If the buyer cancels the order:
BUYER’S OBLIGATION TO INSPECT THE PRODUCT:
The buyer must inspect the product/service subject to the contract before taking delivery and must not accept products/services that are dented, broken, torn in packaging, or otherwise damaged or defective from the courier company. Products/services accepted as delivered will be considered undamaged and in good condition.
After delivery, the buyer must carefully preserve the product/service. If the right of withdrawal is to be exercised, the product/service must not be used. The product must be returned with its invoice.
RIGHT OF WITHDRAWAL:
The BUYER has the right to withdraw from the contract by rejecting the goods without assuming any legal or penal liability and without providing any justification, within 14 (fourteen) days from the delivery date of the purchased product to the BUYER or to the person/organization at the address indicated. This must be done by notifying the SELLER via the contact information provided below.
According to the 6502 Consumer Protection Law and the Distance Sales Regulation, the right of withdrawal can only be exercised if the product maintains its original condition and resalability.
This means that the product should not be used, and only its features and functionality should be inspected under normal usage conditions without performing any actions that would affect its resale condition.
For instance, in the case of electrical kitchen appliances, using the product (e.g., cooking food) may impact its resale condition, thereby restricting the use of the right of withdrawal.
To use the right of withdrawal, written notification must be made to the SELLER within the 14-day withdrawal period via registered mail, fax, email, or another written communication method specified by the SELLER. The product must not have been used in a manner that would violate the "Non-Returnable Products" section stipulated in this agreement.

WITHDRAWAL PERIOD:
If the purchased product is a service, the 14-day withdrawal period starts from the date the contract is signed. The right of withdrawal cannot be exercised for service contracts that have been initiated with the consumer's approval before the end of the withdrawal period. The BUYER has been informed about the withdrawal rights in the Distance Sales Contract and Cancellation Terms and has placed their order with this knowledge.
Costs arising from the use of the right of withdrawal are borne by the SELLER.
To exercise the right of withdrawal, the BUYER must notify the SELLER within the 14-day period via registered mail with return receipt, fax, email, or another written method specified by the SELLER. Additionally, the product must be unused and comply with the "Non-Returnable Products" provisions outlined in this contract.
IMPLEMENTATION OF THE RIGHT OF WITHDRAWAL:
The SELLER is obligated to refund the full payment and any documents that place the BUYER under financial obligation within a maximum of 10 days from the receipt of the withdrawal notification and to accept the return of the goods within 20 days.
If a reduction in the value of the goods occurs due to the BUYER’s fault or if the return becomes impossible, the BUYER is responsible for compensating the SELLER for the damages in proportion to their fault. However, the BUYER is not responsible for changes or damages caused by the proper use of the goods or products during the withdrawal period.
If the use of the right of withdrawal causes the total order amount to fall below the campaign limit set by the SELLER, the discount applied within the campaign is canceled.
Products prepared according to the BUYER's request or clearly tailored to personal needs and those that cannot be returned, such as underwear bottoms, swimwear, bikini bottoms, makeup products, disposable items, perishable goods, or goods with a potential expiration date, cannot be returned. Products that are not suitable for return due to health and hygiene reasons, where their packaging, tape, seal, or protective elements have been opened after delivery, or products mixed with other items and cannot be separated by nature, cannot be returned.
Subscriptions to newspapers or magazines except for those outside subscription contracts, electronically provided services or intangible goods delivered instantly to the consumer, sound or image recordings, books, digital content, software programs, data recording and storage devices, and computer supplies cannot be returned if their packaging has been opened by the BUYER.
Additionally, the right of withdrawal cannot be exercised for services that have commenced with the consumer's approval before the end of the withdrawal period.
Cosmetics and personal care products, underwear, swimwear, bikinis, books, software, and programs that can be copied, DVDs, VCDs, CDs, and cassettes, as well as stationery supplies (toner, cartridge, ribbon, etc.), must have unopened, unused, undamaged, and intact packaging to be returned.
In accordance with the Distance Sales Agreement regulations, the following items are non-returnable:
If the BUYER defaults on credit card payments, the BUYER agrees, declares, and undertakes to pay interest and to be responsible to the card-issuing bank under the credit card agreement between them. In this case, the relevant bank may pursue legal action and claim all associated costs and attorney fees from the BUYER. Under any circumstances where the BUYER defaults on their payment obligation, they are responsible for compensating the SELLER for the damages caused by delayed fulfillment of the debt.
Payments can be made via Bank Transfer or EFT (Electronic Funds Transfer) to one of the designated bank accounts (in TL currency).
For online payments, you can use your credit card, either for a single payment or in installments. Your order total will be charged to your credit card at the end of your order.
